They later identified the passenger, 38-year-old Carlos V. Pina, as the driver at the time of the collision. An impairment test indicated the suspect had been driving under the influence. Officers charged Pina with manslaughter, leaving the scene of a fatal collision and child abuse. They also charged the passenger who swapped seats with hindering prosecution.
